Toews & Murphy provides expert estate planning, probate, business, real estate and tax services to individuals, businesses and nonprofit organizations in California. Founding attorney Christopher Toews holds specialty certificates in both taxation and trusts and estates and has practiced in San Luis Obispo County for over 20 years. He also is past chair of the Exempt Organizations Committee of the Business Law Section, State Bar of California.
We form business entities including corporations, partnerships and LLCs and counsel on the tax consequences of using each form. We also counsel business owners on how to document relationships with partners, lenders, employees, vendors and customers and on liability issues related to business operations.
We design and document estate plans for both large and small estates. Our documentation includes trusts, wills, powers of attorney, health care directives, property agreements and other documents as needed to implement each plan. We make each plan as simple as possible to carry out the client's wishes in a manner consistent with applicable legal requirements.
We advise trustees on legal matters related to the administration of revocable trusts, including notice requirements, duties of the trustee, tax filing requirements and other administration matters. Our goal is to administer and settle each trust in a way that carries out the intentions of the settlors of the trust and which also protects the trustee from liability for actions taken as trustee.
We counsel on many real estate matters, including purchases and sales, tax-deferred exchanges, development and co-ownership agreements, to name a few. We also counsel clients on Federal and local property tax issues related to these transactions.
We design business and estate planning arrangements to carry out our clients' wishes in a tax-efficient manner, and counsel clients on the tax consequences of transactions that we recommend to them. We also handle tax appeals on a selective basis.
We form public and private charitable organizations and obtain their tax exemptions under section 501(c)(3) of the Internal Revenue Code. We also organize other types of nonprofit entities and counsel nonprofit organizations on management, operating and tax matters.
